3. Auction Terms

Bidding: When you place a bid, you are making a legally binding offer to purchase the item at the bid price. Once placed, bids cannot be withdrawn or canceled.

Winning Bids: If you are the highest bidder when the auction closes, you are required to complete the purchase. Failure to do so may result in penalties, including suspension or termination of your account.

Payment: Payment for winning bids must be made within the specified time frame. We accept various forms of payment, which will be outlined in the auction terms. Failure to make payment may result in your account being placed in default.

Buyer's Premium: A buyer’s premium, as specified in each auction, may be added to the final bid price. This fee will be outlined in the auction terms and must be paid along with the winning bid.

All Sales Final: All items are sold "as-is, where-is," with no warranties or guarantees unless explicitly stated in the auction listing. No refunds or returns are accepted for any reason.

Inspection: It is your responsibility to inspect items before placing a bid. If a public inspection is available for an auction, we strongly encourage you to take advantage of it.
4. Auction Modifications
Estate-Bid reserves the right to modify or cancel any auction at any time. This includes, but is not limited to:

Adding or removing items from the auction

Extending or shortening the auction period

Adjusting minimum bids or reserve prices
Any changes to an auction will be communicated through the auction page, and participants are responsible for staying informed of these updates.
5. Item Pick-Up and Shipping

Pick-Up: Winning bidders are responsible for picking up their items at the designated time and location outlined in the auction terms. Failure to pick up items within the specified time frame may result in additional fees, or the items may be considered abandoned.

Shipping: Shipping may be available for certain auctions, but it is not guaranteed. Any shipping arrangements will be outlined in the auction terms. The cost of shipping, if available, will be the responsibility of the winning bidder.
6. Prohibited Conduct
When using Estate-Bid, you agree not to engage in any of the following prohibited activities:

Bidding on your own items or having someone bid on your behalf (shill bidding)

Attempting to interfere with the normal functioning of the website, including hacking, sending spam, or introducing harmful code

Violating any applicable local, state, national, or international law
Violating these rules may result in suspension or termination of your account and may lead to legal action.
7. Limitation of Liability
Estate-Bid is not responsible for any damages or losses incurred as a result of participating in our auctions, using our services, or interacting with other users. This includes, but is not limited to, direct, indirect, incidental, punitive, and consequential damages.
Estate-Bid provides the auction platform "as-is" and does not guarantee the accuracy of item descriptions, auction listings, or the availability of the website. We are not responsible for any errors, interruptions, or technical issues that may occur during an auction.
8. Indemnification
You agree to indemnify, defend, and hold harmless Estate-Bid, its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including legal fees) arising out of your use of our services, your violation of these terms, or any activity related to your account.
9. Dispute Resolution
In the event of any dispute arising from your use of our services, both parties agree to resolve the matter through binding arbitration, in accordance with the rules of the American Arbitration Association. Arbitration will take place in Kansas City, MO, and the decision of the arbitrator will be final and binding.
10. Changes to These Terms
Estate-Bid reserves the right to modify or update these Terms of Service at any time. Any changes will be posted on this page, and the date of the most recent update will be indicated at the top of the policy. Continued use of our services after any changes constitutes your acceptance of the new terms.
11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the state of Missouri, without regard to its conflict of law principles. Any legal actions or disputes will be resolved in the courts located in Kansas City, MO.
